Under the 2018 Regulations, schools are no longer required to establish whether a member of staff providing, or employed to work in, childcare is disqualified by association. Regulation 9 does not apply to staff in a relevant school setting; disqualification by association is only relevant where childcare is provided in domestic settings (e.g. where childminding is provided in the home) or under registration on domestic premises. Accordingly, schools should not ask their staff questions about cautions or convictions of someone living or working in their household. Schools should review their staffing policies and safer recruitment procedures, and make changes accordingly. It is important that schools follow the safer recruitment procedures set out in Part three of KCSIE. Schools and local authorities should also review their safeguarding policies, to ensure that they fully comply with KCSIE, and ensure that their policies are clear about the expectations they place on staff, including where their relationships and associations both within and outside of the workplace.
Safeguarding Self-Assessments and Section 11 Audits
The Kingston and Richmond Safeguarding Children Partnership (KRSCP) strongly encourages all agencies that work with children and young people to ensure their arrangements reflect the importance of safeguarding and promoting the welfare of children and young people.
Working Together to Safeguard Children requires LSCPs to gather data to assess whether partners are meeting their statutory obligations.
In Richmond and Kingston, Schools’ compliance with Section 11 is monitored annually and we would ask school’s Designated Safeguarding Leads to complete a Safeguarding Audit/self-assessment with their Designated Safeguarding Governor. On completion, this should be submitted to Lucy Macarthur at lucy.macarthur@kingrichlscb.org.uk
You may be contacted at a later date in order for us to complete a short monitoring meeting with you, in order to ensure you are addressing the areas of development on your action plan.
Whilst we do not ask for a specific format for this work, the KRSCP recommend this template which has been kindly shared with us by Michele Robbins and which was developed in partnership with Merton Council. Alternatively, schools may wish to use the NSPCC tools to evaluate their own safeguarding effectiveness. Please click here to view it.
For more information, support and suggested templates/toolkits to use, please contact Lucy MacArthur, KRSCP Coordinator at

School Governors have a broad remit in covering all aspects of school life in their oversight, and they may wish contact the KRSCP Governor Rep Aisha Bicknell, Lowther Primary School.
